Terms of Service
These terms apply to your use of the Compare Pryce mobile app and the comparepryce.com website (together, the "Service"). By using the Service you agree to these terms. If you do not agree, please do not use the Service.
1. About Compare Pryce
Compare Pryce is a grocery price-comparison tool. It brings together product and pricing information that Australian supermarkets make publicly available, and shows it side by side so you can make informed choices. The Service is free to use.
Independent service: Compare Pryce is not affiliated with, endorsed by or sponsored by Woolworths Group, Coles Group, ALDI, Metcash/IGA or any other retailer. Supermarket names and logos are trademarks of their owners and are used only to identify where prices come from.
2. Who can use the Service
You must be at least 13 years old to use the Service. If you are under 18, you should have a parent or guardian's permission.
3. Prices and product information
We update prices regularly, but:
- prices may not be real-time and can change without notice,
- prices can differ by store, region, membership or promotion conditions we do not capture,
- availability may differ from what is shown, and
- product details and images may contain errors.
Always check the price at the supermarket before you buy. We are not responsible for differences between prices shown in the Service and the price you pay.
4. Your account
You can use most of the Service without an account. If you create one, you are responsible for keeping your sign-in details secure and for activity under your account. Tell us promptly if you suspect unauthorised use.
You can delete your account at any time. See Delete your account. We may suspend or close accounts that breach these terms or are used fraudulently.
5. Acceptable use
You agree not to:
- use the Service unlawfully,
- use automated tools to access the Service in a way that overloads or disrupts it,
- try to gain unauthorised access to the Service or its infrastructure, or disrupt it,
- reverse-engineer or decompile the app except where the law allows, or
- resell or redistribute price data from the Service without our written agreement.
6. Intellectual property
The Compare Pryce name, logo, app, website and their design and code belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for personal, non-commercial use.
7. Third-party services
The Service relies on third-party providers, as described in our Privacy Policy. Links to supermarket websites are provided for convenience. We are not responsible for third-party websites or services.
8. Disclaimers
The Service is provided "as is" and "as available". To the extent permitted by law, we do not guarantee that it will be uninterrupted or error-free, or that prices and product information will be accurate or current.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to AUD $100.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.
10. App store terms
If you downloaded the app from the Apple App Store or Google Play, these terms are between you and Compare Pryce, not Apple or Google. In addition:
- Apple and Google have no obligation to provide maintenance or support for the app. Please contact us for support.
- We, not Apple or Google, are responsible for addressing any claims relating to the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price (the app is free, so this is nil). Apple has no other warranty obligation for the app.
- You confirm that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.
- You must also comply with the app store's own terms of service when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. Changes
We may change the Service or these terms. We will update the effective date above, and for significant changes we will let you know in the app or by email. Continuing to use the Service after a change means you accept the updated terms.
12. Governing law
These terms are governed by the laws of Australia, and the courts of Australia have jurisdiction over any dispute.
